SPECIAL TRAVEL TERMS THE CALI RALLY 2020


(Please Read Carefully) 


First of all we would like to thank you for your booking with Atlas. We hope you experience a pleasant and delightful trip! 

The Cali Rally is not a race about speed. It’s a cultural rally where Atlas provides a road book with instructions, challenges and activities to be guided along the way. 


Applicability

  1. These terms and conditions will apply to all quotations, offers, activities, orders, agreements and deliveries of services or products by or on behalf of Atlas regarding The Cali Rally.  

  2. Parties can only deviate from these conditions if they have explicitly agreed upon in writing.

  3. The parties expressly exclude the applicability of supplementary and/or deviating general terms and conditions of the customer or of third parties.


General conditions & required information


Atlas (to be referred to as “the organisation”, “us”, “we” and “our” ) does not assume responsibility for those inherent risks which may cause unfortunate accidents or incidents during ordinary travel conditions. The organisation will not be held responsible for injury, death, damage, loss, delay, cost, expense, or inconvenience arising from travel misfortunes beyond our control. 


  1. Travel destination, route and specifics
    The Cali Rally is a travel package organised and created by Atlas that takes place in the United States Of America, specifically in the states of California and Nevada.
    It starts on August 18 2020 in San Francisco and ends on August 30 2020 in Las Vegas. The project will consist of a total of 13 days and 12 nights.

  2. Transport
    Car: During the project, participants shall be driving rental cars, provided by one of the partners of Atlas (Alamo, Enterprise or National). participants will be fully responsible for their own rental car. In case of damage, participants will have to take full responsibility.
    The booking specifics of a rental car booked through Atlas are as follows:
    Pickup date & location: San Francisco – 18/08/2020
    Dropoff date & location: Las Vegas – 30/08/20

    Flight: Participants can book flight tickets to and from San Francisco through Atlas with one of their partners (AirFrance, Norwegian,…) . If not specified, the participant will receive the cheapest ticket possible without any extra purchase of baggage, meals or priority boarding. The participant will be given the choice to book extra options.
    As the project ends in Las Vegas, the participants will be given the choice to:
    – Book a transfer flight from Las Vegas to San Francisco.
    – Extend their car reservation and drive back to San Francisco (change the pick-up location).
    If the participant does not require any of the above, he/she will have to take care of their own return to San Francisco to catch their flight home.

  3. Locations, characteristics and accommodations
    The accommodations booked for participants of The Cali Rally 2020 is a combination of campsites, hotels, motels and hostels. The accommodations are part of the total surprise travel package of The Cali Rally 2020. However all details of the accommodations can be requested by mailing to info@thecalirally.org. There is a possibility to book an upgrade if available by the partner providing the accommodation.

  4. Meals
    No meals are included in the travel package.

  5. Visits, excursions and other services
    All activities, visits, excursions and other services included in the total price of the travel package can be found on our website www.thecalirally.org. If necessary, all details can be provided by mailing to info@thecalirally.org.

  6. Participation
    Participation with The Cali Rally 2020 is open to everyone, including people with reduced mobility, who comes of age (+18) at the time they part on the trip. Be aware that the minimum legal age for alcohol consumption and purchase in the United States of America is strictly +21.

  7. Cancellation policies by the organiser:
    We reserve the right at any time to discontinue the Service (or any part or content thereof) when the minimum amount of 50 participants has not been reached by June 18 2020. We shall not be liable to you or any third-party for any modification, suspension or discontinuance of the Service.

  8. Information regarding passports, visa, travel-, accommodation- and health-regularities
    Every participant must be in possession of valid identity papers. These identity papers and the travel pass must be valid for a minimum of 6 months after the date of return.

    Participants with Belgian nationality can find recent and updated information on the website http://diplomatie.belgium.be/nl/Services/Op_reis_in_het_buitenland or at the Federal Public Service Foreign Affairs in Brussels (tel +32 2 501 81 11). Participants of non-Belgian nationality and/or with only a foreign passport are required to spontaneously declare their nationality to the Organizer and must contact their respective embassies or consulates for up-to-date information on the required travel documents. the Organizer will not accept any liability in the event that any problem could arise in this regard.

    All participants traveling with a Belgian international passport and traveling to and / or via (transit) the United States for a maximum period of 90 days are required to apply for an electronic travel authorization at least 72 hours before departure (the so-called “ESTA travel authorization “, where” ESTA “stands for” Electronic System for Travel Authorization “). This ESTA procedure can only be completed via the web address https://esta.cbp.dhs.gov/esta. In all other cases, special visas are required that must be obtained before departure. The participant acknowledges that these visas do not guarantee access to the country, since the local authorities can still refuse access for various reasons.

    The Organizer cannot be held liable under any circumstances for the participants late receipt of the necessary travel documents. The participant cannot invoke the participant’s late receipt of the necessary travel documents as unavoidable and extraordinary circumstances.

    By offering trips to certain destinations, the Organizer does not guarantee that traveling to such destinations is advisable or risk-free. The Organizer can therefore not be held liable under any circumstances for damage or loss arising from the situation on site. The Organizer advises participants to consult the travel advice (including prohibitions, warnings, announcements and other advice) of the Federal Public Service Foreign Affairs of the chosen destination (http://diplomatie.belgium.be/nl/diensten/Op_reis_in_the_buitenland /reisadviezen/).

    The traveler undertakes to inform himself about the applicable legislation on the (various) destination(s) of the trip (in particular that of a criminal nature). The participants acknowledges that the Organizer cannot be held liable under any circumstances for violations of these laws (including, but not limited to: drugs, weapons, sexual abuse, fraud, etc.).

    Some vaccines are recommended or required for the United States. The CDC and WHO recommend the following vaccinations for United States: hepatitis A, hepatitis B, rabies, meningitis, polio, measles, mumps and rubella (MMR), Tdap (tetanus, diphtheria and pertussis), chickenpox, shingles, pneumonia and influenza.

    The Organisation is not responsible for any health problems arising from environmental factors during your stay. 


  1. The Information regarding deposit, payment, cancellation and transferring of the contract

    The moment the traveler receives the first order enquiry you enter into a booking with us. If you then cancel, there will be cancellation charges. Initially this may only be a deposit but can go up to 100%.

    The traveler needs to pay a 30% deposit of the entry fee within the next 7 days of receiving the first order enquiry. A receipt will be attached in the mail with the specifics of the payment.

All deposits are non-refundable and are also equal to the minimum cancellation fee.

Final Payment is due within the next 30 days of receiving the order enquiry. Any form of payment constitutes acceptance of the Terms and Conditions, Travel Conditions and any extra conditions or policies stated on the site (www.thecalirally.org) or in the personal offer (all conditions can be requested by emailing to info@thecalirally.org).

 

  1. Information regarding taking and the content of a cancellation and travel insurance

Cancellation and travel insurance is advised on The Cali Rally 2020 for every participant’s own safety. The Organisation provides insurance through their partner EUROP-ASSISTANCE. The risks covered by these policies, as well as the costs and the coverage amount are stated on the policy conditions of the aforementioned insurance company. Declarations must be submitted directly to the insurance company by the participant himself in accordance with the policy conditions. Policies can be requested at all times by mailing to info@thecalirally.org or by contacting EUROP-ASSISTANCE.

  1. Contact information of the organiser in case of trouble or problems. 

In the event of difficulties, the participant can always contact the representatives on the phone via the telephone number 0032-476/58 66 90, available from 9 am to 5 pm from Monday to Friday (GMT+1) and/or by e-mail via the e-mail address info@thecalirally.org. Thibaud Ducoulombier handles all requests by e-mail as soon as possible. The participant acknowledges that a reasonable period of time may exist between the receipt of applications and the handling thereof by Thibaud Ducoulombier.

  1. Refusal 

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

  1. Responsibility
    The Organisation will use all due care for the provision of its services and activities provided to guests and will act as a good “. Guests participate in activities at their own risk. No liability or responsibility is accepted by the Organisation for any injury, illness, damage, loss, accident, death, expense, or any other claim arising from involvement in any activities or provision of any services howsoever suffered, even in circumstances where staff of the organisation may have negligently breached any duty of care that it or they may owe or have owed in connection with such activities, conduct, supervision, or the provision of services. The Company will no longer be Atlas  liable for direct or indirect losses, arising from any such injury, illness, death, damage, loss accident, or expense including consequential loss or economic loss however caused.

This website is operated by Atlas. Throughout the site, the terms “we”, “us” and “our” refer to Atlas. Atlas offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. 

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“General Travel Terms and Conditions of Buddha Events BVBA”) including those additional terms and conditions and policies referenced herein. The General Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. 


Please read these General Conditions carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these “General Conditions”. If you do not agree to all the “General Conditions of The Cali Rally 2020” of this agreement, then you may not access the website or use any services. We reserve the right to update, change or replace any part of these “General Conditions of The Cali Rally 2020” by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. By agreeing to these “General Conditions of The Cali Rally 2020”, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services. 



SECTION 3 – PRODUCTS OR SERVICES (if applicable) 

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. 



SECTION 4 – REGISTRATION CONDITIONS 

4.1. Before 

The registration of a participant is final when he/she has correctly filled in the online registration form. The organisation reserves the right to cancel the registration of a participant in case of irregularities or nuisance and to deny them access to its activities. 


4.2 During

 In case of serious crimes, the organisation reserves the right to refuse a participant acces to the entire, remaining and/or any part of the trip, without refund of registration amount or return costs. 


SECTION 5 – LIABILITIES & RESPONSIBILITIES 

5.1 Damage 

Damage caused to third parties and material: if a participant causes damage to both accommodation as well as anything outside, they are ought to pay the requested total amount immediately on the scene. When the damage is determined after departure, an invoice with the supporting documents (of pieces of evidence) will follow. 

Every participant is responsible to check up on the rules and guidelines of every accommodation that is included in the Service upon start of the project, if needed, they can be requested by mailing to info@thecalirally.org. If a participant violates the rules and conditions related to the accommodation, the participant shall be solely responsible for the the resulting fee’s and/or legal responsibilities. 


5.2 Liabilities 

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. 

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non- infringement. 

In no case shall Atlas, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. 

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law. 


5.3 External Responsibilities 

The organisation can and will never be held responsible for any accidents that happen along the way and/or on the road. The participants of The Cali Rally are expected to participate with a 

vehicle that is compliant with legislation and technical condition in the country which the rally takes place. The participants are fully responsible for their own insurance at the car rental agency. 

Atlas can not be held responsible for harm, breakage or theft or any other damage when renting materials from external companies. Here is explicitly the renting of a vehicle mentioned. The customer is personally responsible for whether or not to take out insurance when renting a vehicle. 

Facilities: the number of stars and quality of the various hotels and the quality of the various campsites are determined by the local authorities by the comfort level and the facilities present. Furthermore, the standards differ per country. Atlas can not be held responsible for this. 

Not all rooms in the hotel and/or camping pitches are equally the same, Atlas can not be held responsible for this. 


In case of loss or theft of personal or purchased material during the trip, it will not be refunded by Atlas. 


SECTION 6 – OPTIONAL TOOLS 

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to thee General Conditions.

SECTION 8 – ACCURACY OF BILLING AND ACCOUNT INFORMATION 

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/ phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. 

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly contact us regarding the updating of your account and other information, including your email address, so that we can contact you as needed. 

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libellous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses. 

We may disclose your personal information if we are required by law to do so or if you violate our General Travel Terms and Conditions of Buddha Events BVBA and/or General Conditions of The Cali Rally 2020. 


SECTION 13 – INDEMNIFICATION 

You agree to indemnify, defend and hold harmless Atlas and our parents, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these General Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party. 


SECTION 14 – SEVERABILITY 

In the event that any provision of the General Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions. 


SECTION 15 – TERMINATION 

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These General Conditions are effective unless and until terminated by either you or us. You may terminate the General Conditions at any time by notifying us that you no longer wish to use our Services. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of the General Conditions, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof). 


SECTION 16 – ENTIRE AGREEMENT 

The failure of us to exercise or enforce any right or provision of the General Travel Terms and Conditions of Buddha Events BVBA and the General Conditions of The Cali Rally 2020 shall not constitute a waiver of such right or provision. These General Conditions and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the General Conditions). Any ambiguities in the interpretation of these General Conditions shall not be construed against 

the drafting party. 


SECTION 17 – GOVERNING LAW 

These General Conditions and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Kortrijk, Belgium. 

SECTION 18 – CHANGES TO TERMS AND CONDITIONS 

You can review the most current version of the General Travel Terms and Conditions of Buddha Events BVBA and the General Conditions of The Cali Rally 2020 at any time on the website of The Cali Rally 2020. We reserve the right, at our sole discretion, to update, change or replace any part of these General Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these General Conditions constitutes acceptance of those changes.
