General Terms & Conditions

GENERAL TRAVEL TERMS AND CONDITIONS



B.V. Buddha Events is free to determine its own general travel terms and conditions and. These can

however never be in conflict with the general travel conditions of the Travel Disputes Committee for any

travel arrangements.

The general terms and conditions also serve as the special travel terms and conditions of B.V. Buddha Events.


 

Definitions

  1. Atlas: B.V. Buddha Events, established in Vlamingstraat 4, 8560 Wevelgem, Belgium, Chamber of Commerce no. 0722.807.475.

  2. Customer: the person with whom Atlas has entered into an agreement.

  3. Parties: Atlas and customer together.

  4. Contract: The binding agreement the customer and Atlas have gone into. 


Applicability

  1. These terms and conditions will apply to all quotations, offers, activities, orders, agreements and deliveries of Contracts or products by or on behalf of Atlas.  

  2. Parties can only deviate from these conditions if they have explicitly agreed upon in writing.

  3. The parties expressly exclude the applicability of supplementary and/or deviating general terms and conditions of the customer or of third parties.


Article 1: Prices

  1. All prices used by Atlas are in euros, are inclusive of VAT and exclusive of any other costs such as administration costs, levies and travel-, shipping- or transport expenses, unless expressly stated otherwise or agreed otherwise.

  2. The agreed price in the package travel agreement is – unless apparent material error – fixed and all Contracts mentioned therein are included. The price is indicated per person (unless stated otherwise).

  3. The prices include the Contracts as stated on the website or personal offer at “Including”. Not included are all other costs unless mentioned in specific, such as: 

    1. all optional supplements, ie Contracts for which the consumer can freely choose (such as, but not limited to, insurance, extra baggage, meals, parking costs, use of towels at the beach / swimming pool, transport to and from the airport, visa- and vaccine costs and any personal costs such as laundry, telephone, drinks, room Contract, gratuity etc.); 

    2. all costs not explicitly mentioned in the booking confirmation;

    3. all taxes to be paid locally locally (such as but not limited to: tourist tax, tourist tax, departure tax, etc.) unless otherwise stated.


  4. Prices can be subject to change according to the general travel conditions of the Travel Disputes Committee for any travel arrangements.


  5. The prices stated on the website or personal offer are based on the known prices on the date of drawing up the quotation. If some Contracts (accommodation, transport or other Contracts) are no longer available or have changed in price at the time of reservation, similar alternatives without a price change will be applied. If however the price has to be changed (up or down), the customer will receive notice and a written approval will be asked. 


  6. Atlas waives its right to a possible price increase (and therefore also a possible price reduction) as a result of a change in the exchange rate. By change in arrival or departure taxes, or due to a fuel surcharge at transport of more than 5%, the price will be accordingly adjusted.


  7. Atlas reserves the right to implement any price increases due to an unexpected increase in local costs such as an increase of park fees, local VAT or taxes imposed by the government in the country of destination. This can happen after the signing of the order form (but never after date of departure). Atlas will manage carefully and wisely to minimise additional charges and this only in extremely unexpected situations. 


  8. If Atlas changes the total price of the trip after the customer has received the final invoice, and it increases by more than 8%, the customer has the right to cancel the package travel agreement without break compensation. In this case the customer is entitled to a refund of the amount he has paid to Atlas.


Article 2: Payment procedure
All payment procedures are specific per project and are stated in the Specific Project Terms and Conditions of the designated project. 

In general payment procedure will go as followed:


  • A deposit of 30% the basic ticket fee (entrance to the project) must be paid in general no later than 7 days after receiving the first invoice;
    When booking non-refundable accommodations, Contracts or other extra options as indicated in the quote, the deposit might be increased. Atlas starts booking and reserving your Contracts as soon as the agreed advance has been received;

  • A second deposit can be applied, this will be a total of 50% of the invoice, including all extra options, contracts and/or services

  • Final payment must be paid no later than 4 weeks before departure unless stated otherwise.


Any form of payment constitutes acceptance of all the terms, agreements and conditions of Atlas. If the remaining amount has not been received within the given time, we have the right to cancel your booking with the mentioned cancellation costs.



Article 3: Late payment

The customer who fails to pay the advance or the travel sum within the stipulated period will automatically and without notice of default require an interest of 8% on an annual basis more compensation of 10% with a minimum of 100.00 euros on the unpaid advance or on the unpaid travel sum to Atlas. 

If the customer does not have cancellation insurance for protection, this will not be reimbursed.


Article 4: Specific services

Air transportation

If the customer does not have his e-ticket with him at the airport of departure, he can as a rule still embark on presentation of his identity documents and without additional costs if the airline permits this.


Atlas will inform the customer upon departure up to 48 hours before the flight of any flight change(s) that the airline(s) can implement. Atlas may deviate from this during extended weekends. After this time and during extended weekends, the customer is responsible for checking any flight hour(s) change(s). The customer is also responsible for checking any flight hour(s) of the return flight (s). Atlas is not responsible for missing the flight(s) if this rule is not observed.


Atlas cannot be held liable for any consequence resulting from delays, strikes or other actions that have an impact on the normal course of air transport Contracts.


Airlines have special rules regarding the transportation of disabled people, pregnant women, babies, children and pets, among others. If necessary, the customer confirms to have taken note of this. Atlas cannot be held liable under any circumstances for the consequences arising from non-compliance with the applicable rules imposed by the airline concerned.


Train & Bus

Atlas points out that the precise execution of the train and/or bus Contracts may vary depending on the airport(s) and/or airline(s) and/or train and/or bus station(s) that may be part of the chosen travel route. Atlas informs the customer in a timely manner about the various implementation modalities that are known to it that apply in that regard. Atlas cannot be held liable under any circumstances for the consequences arising from non-compliance with the applicable implementation modalities.


Atlas cannot be held liable for all consequences arising from delays, strikes or other actions that have an impact on the normal course of the train Contracts. 




Accommodation 


The customer acknowledges to be aware of the accommodations and the general rules and laws that apply in the designated country the project will be held. If damage to the accommodation has been caused by the customer, the customer must provide full compensation for this. Atlas is not liable for any damage caused by the customer(s).


Rental car  


Rental cars can only be booked and driven by people who have a valid credit card. Credit cards must be valid for at least 6 months in relief and at the time of booking the rental car. Prepaid cards are not accepted when booking rental cars. 

In Europe, a valid national or European driving license is mandatory for anyone driving a car. Outside of Europe, an international driver’s license, mandatory accompanied by a national or European driver’s license, is often a requirement. Atlas provides general information in that regard in a timely manner. It is the responsibility of the driver(s) to inform themselves in advance about the applicable driving license rules at the competent authorities (embassy or consulate of your destination). Atlas points out that car rental companies usually charge a surcharge in the event that the place where the car is returned (the “drop-off” place) does not match the place where the car was picked up (the “pick-up” place) .



Article 5: Timetable of carriers

The stated timetables of carriers are indicative. The customer must in all circumstances take into account that these can be changed both before and during the trip. 

Changes in the timetables of carriers can influence the travel time. The customer is not entitled to a full or partial refund of the travel sum if, due to changes, the departure times do not deviate more than 36 hours from the original time.

Article 6: Formalities

The customer confirms to have taken knowledge of the information regarding the formalities to be completed and the duration for obtaining them that are communicated to him in the Package Travel Agreement. The customer must be in possession of valid (not expired) identity documents for the reserved trip. The customer is responsible for the possible obtaining of the necessary visas or other necessary travel documents. Travellers of non-Belgian nationality must spontaneously communicate their nationality and contact the embassy of the destination country in order to obtain the necessary information regarding the travel documents.




Minors are not allowed on any of the projects, Contracts or travels of Atlas unless stated otherwise in the Specific Project Terms and Conditions .


When registering, the customer must provide the name data as stated on his official identity documents. If an error leads to additional costs (ticket, permit), these are at the expense of the customer. In the event of non-compliance with the legal requirements of the country concerned, the resulting damage is also at the expense of the customer.



Article 7: Travel program and course of the designated project

The travel program of the designated project is described on the website/page of the project and/or personal offer and/or Specific Project Terms and Conditions of Atlas and pre-contractual information that forms part of the package travel agreement. Photos in all documents, brochures and on the website are illustrative and do not form part of the contract. 

The content and order of the travel program may change due to unforeseen circumstances beyond the control of Atlas (state of the roads, weather conditions, natural disasters, political unrest or instability). Atlas and his agents will always do the necessary to ensure that the program continues as far as possible.


The customer will have to follow the guidelines of the travel guide regarding safety, the course of the trip and the condition. If these guidelines are violated, the trip can be stopped without being able to claim compensation or reimbursement of part of the travel sum.



Article 8: Transferability of the booking

The Passenger Transport Tickets (such as train and airplane tickets) issued are not transferable or refundable, unless explicitly stated otherwise. 

The customer can only transfer the other booked Contracts to a third party prior to the start of the journey on condition that (1) Atlas has explicitly confirmed prior to the request for transfer to the customer that this possibility exists and (2) this third party meets the conditions of the Contract. 

The transferor must immediately and no later than 7 days prior to departure inform Atlas of this request for transfer and provide all necessary details for the execution of the transfer. The transfer only takes effect after explicit confirmation by Atlas. In addition to all additional fees, surcharges and other costs resulting from the transfer, Atlas will charge an administrative fee per transfer in accordance with Article 11 of these General Travel Conditions. 

In all the above cases, the transferor and transferee are jointly and severally liable for payment of the total price of the Contracts transferred and the associated costs.



Article 9: Other modifications by the customer

To the extent that the requested changes can be made, all related costs will be borne by the customer. For each type of change and per unit, the customer will also oweAtlas an administrative cost of 50 euros per person, any extra costs will be charged to the customer. Atlas cannot guarantee that changes requested by the customer before or during the trip, but after the conclusion of the Contract, can be implemented:

  • Air transport: In principle, airline tickets cannot be changed after issue, unless explicitly stated otherwise. If a change after issuance would nevertheless be possible in accordance with the terms and conditions of the airline(s) concerned, this is only possible upon payment of the contractually agreed fees, as determined by these airline(s); 

  • Rental car: Changes with regard to booked rental cars can only be carried out in accordance with the conditions of the rental company(s) concerned and subject to the payment of the fees determined by the rental company. Changes can in no way be implemented on the day on which the originally provided rental period starts; the total price will therefore remain due;

  • Hotels or other accommodations: Changes other than those related to the same hotel or other accommodation (room type, date of stay, etc.) are considered a cancellation within the meaning of Article 4 of these General Travel Conditions (eg change of hotel or accommodation).



Any repayment following a change will be made to the bank account or payment card (eg credit card) of the customers known to Atlas. This reimbursement takes place after deduction of file costs, the aforementioned modification costs and any reimbursements that would be due by the insurer (without prejudice to the possible application of a franchise by the insurer). 
The customer must take into account that the reimbursement of booked Contracts can take several months. In order to avoid any misunderstanding in this regard, Atlas points out that an insurance policy booked through its intervention can under no circumstances be reimbursed by it.



Article 10: Cancellation by Atlas

Atlas reserves the right at any time to discontinue the Contract (or any part or content thereof)

and without any form of claim if:

  • At least 30 days before the start of the package, if the number of people who have registered for the package is smaller than the minimum number stated in the Specific Project Terms and Conditions regarding the project. 

  • Before the start of the package and in any case without undue delay, if the Contract cannot be performed due to unavoidable and extraordinary circumstances (force majeure). 

  • We shall not be liable to you or any third-party for any modification, suspension or discontinuance of the Contract.



Article 11: Cancellation by the customer

Full cancellation by the customer

The customer can cancel the package travel contract at any time before the start of the package tour. In case of cancellation, the customer can be obliged to pay a cancellation fee to Atlas.



  • From the day of registration up to and including the 57th day before departure, a cancellation fee of 15% will be charged. 

  • From 56th day to 29th day before departure, a 40% cancellation fee will be charged. 


  • From 28th day to 15 days before departure a cancellation fee of 60% will be charged. 


  • From 14 days before departure a cancellation fee of 100% will be charged. 





The cancellation by the customer can be done by sending a written letter to the registered office of Atlas or mailing to info@discovery-collective.com . The cancellation request for airline tickets must reach Atlas at least 48 hours before the start of the flight. The customer acknowledges that the timely submission of the cancellation request may be relevant to limit the cancellation costs.


If however the customer can find a replacing customer and Atlas succeeds in giving through all the changes to specific service provides (such as, but not limited to: Airline, bus, accommodation,…), then the customer will only pay an administration fee of 100 EUR.


When cancelling the package travel contract, special terms apply regarding the booked services: 


  1. Air transportation


If the customer wishes to cancel the booked airline tickets before issuing them, Atlas will charge an administrative cost of: 

  • 50 EURO per person if the total price of the ticket is 500 EURO or less ;

  • 100 EURO per person if the total price is more than 500 EURO. 

In principle, plane tickets cannot be canceled after issue, unless explicitly stated otherwise. 


In the case of non-cancellable airline tickets, only the fees that Atlas receives from the airline(s) can be reimbursed, with an administrative cost of 50 EURO per ticket. If a cancellation after issuance would be possible under the terms and conditions of the airline(s), the customer will still owe Atlas an administrative cost of: 

  • 75 EURO per ticket if the total price of the ticket is less than 350 EURO;

  • 100 EURO per ticket if the total price of the ticket is between 350 and 700 EURO;

  • 125 EURO per ticket if the total price of the ticket is more than 700 EURO.



Train/Bus


The booked train / bus tickets can be canceled with payment of the fees set by the train company, more administrative costs of 50 EURO per person to Atlas.


Rental Car 


Booked rental cars can be canceled subject to payment of an administrative fee of 15%, and a minimum of 50 euros per rental car if the cancellation is made at least 30 days before the start of the rental period, or 50% and a minimum of 100 euros per rental car if the change is carried out between the 29th day before the start of the rental period and the last day before the start of the rental period. In no case can cancellations be made on the day on which the originally scheduled rental period starts, the total price will therefore remain due.


Hotels, other accommodations and excursions


The cancellation fee for hotels and other accommodations and excursions (such as, but not limited to, guided tours, transfers, city passes, etc.) is as follows: 

  • 
57 days before departure: 15% of the total price of the hotel, the other accommodation and / or excursion with a minimum of 50 euros per person; 


  • 56-29 days before departure: 40% of the total price of the hotel, the other accommodation and / or excursion with a minimum of 100 euros per person; 


  • 28-15 days before departure: 60% of the total price of the hotel, the other accommodation and / or excursion with a minimum of 150 euros per person.


  • In no case can cancellations be made if the cancellation were requested within 14 days prior to departure; the total price of the hotel or other accommodation will therefore remain due.


Refund


Any reimbursement due to cancellation will be deposited by Atlas into the known bank account or payment card of the customer, after deduction of file costs, the above-mentioned cancellation costs, any previously made change costs and any reimbursements that would be due by the insurer (without prejudice to the possible application of a franchise by the insurer). The customer acknowledges that the reimbursement of booked Contracts can take up to 6 months.




Article 12: User comments, feedback, complaints and other submissions

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, ‘comments’), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.


We may, but have no obligation to monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Special Travel Terms and Conditions.


You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libellous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Contract or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.


The customer shall inform Atlas without delay of any non-conformity that he has noticed or discovered during the performance of a contract.


All complaints regarding the trip must be notified to Atlas in writing immediately and at the latest within one month after return. Complaints that are formulated after this period will be considered late by Atlas and therefore inadmissible.



Article 13: Errors, inaccuracies, omissions

Occasionally there may be information on our site or in the Contract that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Contract or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). 

We undertake no obligation to update, amend or clarify information in the Contract or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Contract or on any related website, should be taken to indicate that all information in the Contract or on any related website has been modified or updated.



Article 14: Indemnification

You agree to indemnify, defend and hold harmless Atlas and our parents, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Contract providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Special Travel Terms and Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.



Article 15: Liabilities & Responsibilities of Atlas


Liabilities:

We do not guarantee, represent or warrant that your use of our Contract will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the Contract will be accurate or reliable.

You expressly agree that your use of, or inability to use, the Contract is at your sole risk. The Contract and all products and Contracts delivered to you through the Contract are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representations, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.





In no case shall Atlas, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Contract providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Contract or any products procured using the Contract, or for any other claim related in any way to your use of the Contract or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Contract or any content (or product) posted, transmitted, or otherwise made available via the Contract, even if advised of their possibility. Because some states or jurisdiction do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdiction, our liability shall be limited to the maximum extent permitted by law.



Responsibility:

Atlas is responsible for the proper execution of all travel Contracts covered by the agreement, in accordance with articles 33, paragraph 1 and 34 to 40 of the Travel Contract Law.
In addition, it must provide assistance if the customer is in difficulty, in accordance with Articles 43 and 44 of the Travel Contract Law. 



Atlas cannot be held liable with regard to Contracts that the customer has booked through Atlas with one or more Contract Providers, unless otherwise provided in the Travel Contract Law. Under no circumstances will Atlas be liable for any material errors, regardless of the Contract Provider’s information. Atlas is also not liable if the non-conformity of the agreement and/or any damage is due to (1) the customer, (2) a third party who is not involved in the performance of the travel Contracts included in the Contract is involved and the non-conformity could not have been foreseen or prevented or (3) unavoidable and extraordinary circumstances. 

Except for personal injury or damage caused intentionally or negligently, Atlas limits the compensation provided for under the Travel Contracts Act to a maximum of three times the total travel sum of the Contract/package tour. Atlas is not liable if and in so far as the customer is able to claim his compensation under an insurance policy, such as travel and/or cancellation insurance.

External responsibilities:

Atlas can and will never be held responsible for any accidents that happen along the way. Atlas can not be held responsible for harm, breakage or theft or any other damage when renting materials from external companies.


Luggage

Atlas is not responsible for any loss, theft or damage to any kind of luggage. In the event of loss, theft or damage to luggage, the customer must complete a property irregularity report at the lost luggage department of the airport. Without this document it is impossible to obtain a refund. The advice about the permitted weight of the luggage must be followed. Any additional costs for overweight are at the expense of the customer.



Facilities:

The number of stars and quality of the various hotels and the quality of the various campsites are determined by the local authorities by the comfort level and the facilities present. Furthermore, the standards differ per country. Atlas can not be held responsible for this. Not all rooms in the hotel and/or camping pitches are equally the same, Atlas can not be held responsible for this.



Article 16: Privacy and personal information 

Atlas respects the privacy of its customer(s), in accordance with applicable law. 


The customer acknowledges and accepts that all personal data communicated by the customer or entered online, with the exception of the data entered for his travel group, can be processed by Atlas. The purpose of this processing is to be able to realise the optimal execution of the Contract for the benefit of the customer. The personal data can also be used by Atlas for commercial and communication purposes. 


The customer furthermore agrees that his data can be communicated to processors of personal data that Atlas uses and other Contract Providers who need the data to be able to implement the Contract. Atlas undertakes not to disclose personal data to other third parties unless the explicit permission of the customer has been obtained or otherwise legally permitted.


The customer can at any time, free of charge and upon simple request, oppose the biased processing of personal data relating to him if this processing were to be carried out with a view to direct marketing. 

The customer has the right to access the personal data that relates to him and that is processed by Atlas and can, if necessary, correct incorrect data and have the data processed unlawfully deleted. If the customer wishes to exercise these rights, or if the customer has other questions regarding the use of his personal data by Atlas, he can contact Atlas.


Your submission of personal information through any website of Atlas is governed by our Privacy Policy.


We may however disclose your personal information if we are required by law to do so or if you violate

the Special Travel Terms and Conditions of the Organizer.



Article 17: Governing law and competent court

  1. Only Belgian law applies to every agreement between parties.

  2. The Belgian court in the district where Atlas is established / has its practice / has its office is exclusively competent to take cognizance of any disputes between the parties unless the law prescribes otherwise.



Article 18: Changes to the general travel terms and conditions

  • Atlas is entitled to change or supplement these general terms and conditions without notice.

  • Changes of minor importance can be made at any time.

  • Atlas will discuss major substantive changes with the customer in advance as much as possible.

  • Consumers are entitled to cancel the agreement in the event of a substantial change to the general terms and conditions.



Article 19: Final Provisions

  • If the customer does not invoke at any time one of the provisions of the Special Travel Conditions of the Organizer or the General Travel Conditions of the Travel Disputes Committee, this cannot be interpreted as a distance in the most important of the customer of the right to invoke these provisions at a later date.

  • If a provision of the Special Travel Terms and Conditions of the Organizer or the General Travel Terms and Conditions of the Travel Disputes Committee were wholly or partially unlawful, void or unenforceable, the provision in question no longer forms part of these Special Travel Terms and Conditions of the Organizer or the General Travel Conditions of the Travel Disputes Committee.
    The legality, validity and enforceability of the other provisions is nevertheless retained.

  • Every circumstance of force majeure, led to the termination of means of communication by, among others, carriers, hoteliers of air traffic controllers, leads to suspension of the obligations in the Special Travel Conditions of the Organizer and of the General Travel Conditions of the Travel Disputes Committee . The party who had to comply with the probable obligation assigned by force majeure cannot be made obliged.

  • The failure of us to exercise or enforce any right or provision of these Special Travel Conditions of the Organizer and of the General Travel Conditions of the Travel Disputes Committee shall not constitute a waiver of such right or provision. 
The Special Travel Conditions of the Organizer and of the General Travel Conditions of the Travel Disputes Committee and any policies or operating rules posted by us on this site or in respect to the Contract constitutes the entire agreement and understanding between you and us and govern your use of the Contract, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Special Travel Conditions of the Organizer and of the General Travel Conditions of the Travel Disputes Committee). 
Any ambiguities in the interpretation shall not be construed against the drafting party.
